Terms & Conditions of your Booking
Hayne Barn Estate
The following Terms and Conditions apply to bookings made by the customer (“You”) at Hayne Barn Estate, Saltwood, Hythe, Kent, CT21 4EH (“the Site”) to occupy our yurts. These Terms and Conditions form the basis of your contract with Hayne Barn Holdings Limited, Hayne Barn, Saltwood, Hythe, Kent, CT21 4EH (company no. 02626209) (“We / Us”) us so please read them carefully before making a booking.
- Definitions
“Booking Confirmation” | means the confirmation of booking provided to you when the Booking Deposit has been paid |
“Booking Deposit” | Means a non-refundable deposit of 50% of the Fees; |
“Booking Form” | means the online booking form completed by you; |
“End Date” | means the last day of your occupation; |
“Fees” | means the fees specified in the Booking Form; |
“Occupation Period” | means the duration of your stay specified in the Booking Form; |
Damage Deposit | £30 |
“Start Date” | means the first day of your occupation |
- Booking and Payment of Booking Deposit
- A booking is made by completing and submitting the online Booking Form and paying the Booking Deposit.
- The guest must be over 18 years of age at the time of the booking.
- Once we have received the Booking Form and the Booking Deposit we will send you a Booking Confirmation. At this point a binding contract exists.
- On receipt of the balance payment of the Fees, the lodge will be made available to you from 3 pm on the Start Date (or at the time and date agreed in advance) and you and your guests are required vacate by 10 am on the End Date stated. We may agree to a later check-out entirely at our discretion.
- Payment of Fees
- You must pay the balance of the Fees due no later than 21 days prior to commencement of the booked Occupation Period, to guarantee the booking.
- If you are booking within 21 days of the commencement of the Start Date, payment is required in full when the Booking Form is completed.
- Damage Deposit
- You must pay the Damage Deposit to the us at the same time as the balance payment.
- The Damage Deposit will be held by us and applied against the cost of remedying any damage, loss to the Property caused by you, your guests or excessive cleaning found necessary following the Occupation Period.
- The Damage Deposit, less any deductions made for the cost of remedying any damage, will be returned to you within 14 days of the End Date.
- Any extra expense needed to make good any damages will be charged directly to you.
- Cancellation
- If you do not pay the balance of Fees due by 21 days before the Start Date, we reserve the right to cancel and re-book your holiday and to forfeit the Booking Deposit.
- Once the booking is confirmed you are liable for the whole of the Fees. Cancellation and curtailment protection insurance is therefore We do not offer this service.
- Cancellation requests must be made in writing.
- If, following your cancellation, we are able to re-let the lodge(s),with another customer, we will refund the amount recouped, less the non-refundable deposit.
- We do not insure your holiday, and recommend uyou take out a separate holiday&cancellation insurance as you will still be liable for your holiday in the event of a cancellation.
- Your rights during the Occupation Period
- You may use the paths and drives leading to the Site.
- You may use such parts of the Site as the we have designated for shared use.
- Your obligations during the Occupation Period
- You agree to:
- use the Site facilities in a reasonable and careful manner.
- place all refuse in the receptacle(s) provided for the Lodges.
- ensure that children will be properly supervised at all times on the Site.
- comply with any regulations which we may from time to time make in the interests of good management of the Site.
- use the hot tub responsibly, carefully following the safety instructions provided at the Site. Children under 5 are prohibited from using the hot tub as high temperatures can affect little ones much quicker than adults. Older children can use the hot tub but must be accompanied by an adult at all times.
- remove your belongings from the Lodges when you depart and to leave the Site and Lodgesclean and tidy.
- You agree not to:
- allow the (Lodge (s) to be occupied by more than the number of people specified in the Booking Form.
- use the Lodge(s)for any stag or hen parties, no groups of single sex guests are permitted on the Site.
- do anything at the Site which may be a nuisance to or cause damage or annoyance to us or other occupiers of the Site, including, without limitation, making loud noises so as to disturb other guests.
- play any music, musical instruments, or audio devices between the hours of 8.00 pm and 8.00 am.
- use the Lodges and the Site for any illegal or immoral purposes.
- cause or allow any dangerous or inflammable substance to collect in the Lodges or on the Siteapart from those designed for use with outdoor cooking equipment.
- bring any animal or pet to the Site.
- smoke in the Lodges or with extreme care on the wooden deck and surrounds.
- Termination
If you substantially breach any of your obligations under these Terms and Conditions or if the behaviour or level of noise generated by the you or any of your guests is unacceptable to us, we may with immediate effect terminate your permission to use the Site and the Lodges must be vacated and no refund will be given.
- Furnishings, Linen, etc.
- Each lodge is furnished and equipped to cater for the number of occupiers stated in the Booking Form.
- Bedding (pillows and blankets or duvets) and linen, bathroom towels, and tea towels are provided but NOT HOT TUB TOWELS..
- If two persons have booked it will be assumed that a double bed is required unless otherwise stated in the Booking Form.
- Babies cots are not provided. Cots can be added only in Woodpecker, Pheasant and the studio.
- Hot Tubs
- Full guidance on the safe use of the hot tub is provided. It is your responsibility to read and understand this prior to using the hot tub.
- Wood-fired hot tubs require heating using a wood-burning stove. A set amount of specially designed briquettes, kindling will be provided as part of and included in the cost of the hire to light the hot tub once. Additional set amount of briquettes and kindling can be purchased on site.
- It is your responsibility to heat the hot tub which will be made available to you from 3 pm on any given Start Date. The hot tub takes approximately 3 hours to heat to a suitable bathing temperature. Heating times are approximate and will change according to outside air temperature, stove/fire management, etc. Please do not leave any fire unattended (hot tub or barbecue).
- Our hot tubs are checked for each stay by onsite staff to keep them clean and safe to use.
- Use of the hot tub is at your own risk.
- Please note that prolonged submersion in the hot tub may cause heat spots.
- You are responsible for your own safety whilst you are using the hot tub.
- Force Majeure
We are not liable for refunds or expenses incurred by you in the event that we are prevented from fulfilling your booking as a result of circumstances beyond our control. Such circumstances shall include (but not be limited to) war, terrorism, riots or civil unrest, industrial action, flooding, natural disaster, epidemics, health risks or such similar events (“Force Majeure”). We recommend that adequate holiday insurance is purchased to cover this.
12.Complaint procedure
If the guest has any complaint about the property, it must be reported at the earliest opportunity during your stay, within normal hours, no later than 24 hours after its occurrence and not after your departure. A phone number is left in the lodge.
Our team is at your disposal and will endeavour to resolve all issues. Access to the property might be required.
13.General
- We accept no responsibility for the personal possessions of you and your party. Vehicles and possessions are left entirely at the your own risk.
- Any obligation on you in these Terms and Conditions not to do an act or thing includes an obligation not to permit or suffer another person to do such act or thing.
- To the fullest extent permissible by law our liability for any loss or damage suffered by you or members of your party shall be limited to that which arises out of the negligence of our employees, sub-contractors or agents.
- Whenever you the customer are more than one person, your obligations may be enforced against all of you jointly and against each of you individually.
- You agree with us that we do not intend that the contract between us should be enforceable by any person solely by virtue of the Contracts (Rights of Third Parties) Act 1999.
- An obligation in these Terms and Conditions to pay money includes an obligation to pay Value Added Tax in respect of that payment, if applicable.
- This contract between you us shall be governed by the law of England and Wales.
14.Privacy Policy
- Our privacy policy sets out how we use and protect any information that you give us when you use this website.
- We committed to ensuring that your privacy is protected. Any information provided will only be used in accordance with this privacy policy and will not be passed onto any third parties unless required to do so by law.
- What we collect
We may collect the following information:
- Name, address, contact information including telephone number and e-mail address as well as details of other members of your family/group etc
- Other information relevant to customer surveys and/or offers
- How we use this information
Our aim is to provide our customers with the best possible holiday experience we can. Information collected will help us to understand what you want from your holiday and enable us to continually improve how and what we offer. In addition, we will use any information provided;
- For our internal records.
- To improve our products and services.
- To contact ‘opted in’ customers periodically to send promotional flyers, newsletters, special offers and information about new products or services.
- Cookies
A cookie is a small file of letters and numbers that is downloaded on to your computer when you visit a website. Cookies are used by many websites and can do a number of things, eg remembering your preferences, recording what you have put in your shopping basket, and counting the number of people looking at a website.
We use cookies to identify which pages are being viewed. This helps us analyse data about how our website is being used and enables us to improve this experience. We only use this information for statistical analysis purposes. Cookies do not give us access to your computer, personal data or any other personal information other than that supplied by you to us through the booking process.

- Opt ‘in’ or ‘out’
We require a certain amount of personal information to confirm the booking with us. However, you will be given the opportunity to opt-out of receiving any further information from us in the future. You can do this in the following ways;
- Check the ‘opt-out’ box underneath the booking form. By ticking this you will not receive any further information from Hayne Barn Estate.
